Terms of Service

1. Scope of Agreement

These Terms of Service govern all transportation and logistics services provided by FP Transport LLC. By requesting a quote or booking a load, the customer (Shipper/Broker) accepts these terms in full.

2. Quotes and Rate Confirmations

All rates provided by FP Transport LLC are subject to equipment availability and fuel price fluctuations. A contract is only binding once a formal "Rate Confirmation" has been signed by both parties. Any changes in weight, dimensions, or pickup/delivery details may result in rate adjustments.

3. Carrier Liability (Carmack Amendment)

In accordance with the Carmack Amendment (49 U.S.C. § 14706), FP Transport LLC liability for cargo loss or damage is limited to the extent of our insurance coverage unless a higher value is declared in writing prior to shipment. Shippers are responsible for ensuring all cargo is properly packaged and secured for transit.

4. Detention and Accessorials

Standard loading/unloading time is 2 hours. FP Transport LLC reserves the right to charge detention fees for delays exceeding this timeframe. Layover, lumper, and TONU (Truck Order Not Used) fees will apply as per our standard rate schedule.

5. Mountain Operations (Colorado Specific)

Due to our location in Gypsum, CO, FP Transport LLC reserves the right to delay shipments due to extreme weather, chain laws, or pass closures (e.g., Vail Pass/Eisenhower Tunnel) for the safety of our drivers and your cargo.

6. Governing Law

This agreement shall be governed by the laws of the State of Colorado. Any disputes shall be resolved exclusively in the state or federal courts located in Eagle County, CO.
